1. Introduction
Welcome to CRFTD and HM Wellness. These Terms of Service set out the agreement between you and HM Wellness & CRFTD Coaching Holdings Limited (“we”, “us”, or “our”). By using our website, purchasing any program, product, or membership, or taking part in any of our services, you agree to these terms. Please read them carefully before using any of our services or facilities.
We reserve the right to update these terms at any time. Changes will take effect once they are published on our website. Your continued use of our services means you accept the updated version.
2. Our Services
We provide gym memberships, group training, personal coaching, online programs, nutrition education, and the sale of related products. From time to time we may add or remove services without prior notice.
Access to our physical locations, digital platforms, and online programs may vary depending on your membership or purchase type. We always aim to deliver services as described but cannot guarantee that facilities or digital content will always be available without interruption.
3. Memberships and Payments
All memberships, subscriptions, and program payments must be made in full or through approved recurring payment arrangements. By agreeing to a direct debit or subscription, you authorise us and our payment partners to charge your nominated account according to the plan selected.
If a payment fails, we may suspend your access until the payment is received. Repeated failures may result in cancellation of your membership or access.
Prices are listed in New Zealand Dollars and include GST unless stated otherwise. We may adjust pricing at any time. Any change will apply from your next billing cycle with reasonable notice.
4. Cancellations and Refunds
You may cancel a gym membership or online program according to the terms set out in our Refund and Cancellation Policy. Cancellations must be made in writing through the appropriate channel.
Refunds are only available as stated in that policy and are processed to the original payment method where applicable. We do not refund partial months or unused sessions unless required under the Consumer Guarantees Act 1993.
5. Use of Facilities and Conduct
We expect all members and visitors to act respectfully and responsibly when using our facilities, attending events, or engaging online. This includes keeping equipment clean, returning weights, and following coach or staff directions.
We reserve the right to refuse entry, cancel a membership, or remove any participant who behaves in a way that is unsafe, disruptive, or contrary to our values.
Children under the age of sixteen must be accompanied by a parent, guardian, or coach unless otherwise arranged.
6. Online Programs and Digital Access
Access to online programs, courses, or digital content is granted to the purchaser only and may not be shared, copied, or resold. You agree not to distribute, record, or reproduce our content without permission.
We make every effort to ensure our online materials are accurate and accessible. However, we are not responsible for technical issues or interruptions beyond our control.
7. Intellectual Property
All logos, designs, videos, text, and training resources created by CRFTD and HM Wellness are owned by HM Wellness & CRFTD Coaching Holdings Limited. They may not be reproduced or used for commercial purposes without written permission.
Any materials provided to you during coaching or courses are for personal use only unless otherwise agreed.
8. Health and Safety
Training involves physical exertion and carries inherent risks. By participating in any class, program, or activity, you confirm that you are physically able to do so and have no medical conditions that prevent participation. You agree to notify staff of any injury, condition, or concern that may affect your safety.
We take all reasonable steps to provide a safe environment, but you participate at your own risk. You agree that we are not responsible for any injury, loss, or damage that may occur except where required by New Zealand law.
9. Coaching and Advice Disclaimer
Information provided through coaching, training, nutrition guidance, or digital education is for general educational purposes only. It is not a substitute for medical or professional advice. Always consult a qualified healthcare provider before making major changes to your exercise, nutrition, or lifestyle routines.
10. Product Sales and Shipping
Products purchased through our online store will be processed and shipped as described at checkout. Delivery times may vary depending on location and courier services.
We are not liable for delays caused by postal or courier services, customs, or circumstances beyond our control. Damaged or incorrect products should be reported to us within seven days of receiving your order.
11. Limitation of Liability
To the fullest extent permitted by law, HM Wellness & CRFTD Coaching Holdings Limited will not be liable for any indirect, consequential, or incidental loss or damage arising from the use of our services, facilities, or website.
Our total liability in any case will not exceed the total amount you have paid to us for the relevant service or product.
12. Privacy and Data
